**CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION RETURN CONDITIONS**
**GENERAL:**
If you order electronically from www.artparisagallery.com, you are deemed to have accepted the pre-information form, refund policy, personal data protection law, privacy and security policy, and distance sales contract provided to you.
Buyers are subject to the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they have purchased.
Shipping costs for product shipments will be paid by the sellers selling on artparisagallery.com marketplace.
Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within 30 days, provided that it does not exceed the legal period. Delivery times may vary for custom designs, personalized, and post-order manufactured products.
The purchased product must be delivered complete and in compliance with the specifications stated in the order, along with any warranty certificate, user manual, or other documents.
If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of becoming aware of the situation. The total amount must be refunded to the Buyer within 14 days.
Cancellation, return, and exchange are not possible for products manufactured upon order, such as furniture, home decoration, and lighting, after product delivery. Once products are received and used, for activities such as photography, birthday parties, cancellation, return, and exchange are not accepted.
**NON-PAYMENT OF THE PURCHASED PRODUCT PRICE:**
If the buyer does not pay the purchased product price or cancels it in the bank records, the seller’s obligation to deliver the product ends.
**EXCEPTIONS TO CANCELLATION, RETURN, AND EXCHANGE:**
(a) Products with personalized names or custom dimensions. (b) Undergarments, socks, earrings, etc., which may have issues being resold hygienically. (c) Furniture and home decoration products to be produced upon order, clothing (in case of ordering such products, the customer is informed within 24 hours after the order, indicating that cancellation, return, and exchange conditions will not apply, and if desired, a refund will be made; otherwise, it is stated that cancellation, return, and exchange of sent products will not be accepted. The order is processed or canceled after the customer’s response.) (d) Products whose packaging loses its saleability when opened, has damaged packaging, missing parts, broken, or defective without a record in the delivery process. (e) Malicious returns, where products are ordered and used for photography, decor, activities (birthday, New Year’s party, etc.), and returned afterwards, returns are not accepted. (f) In case of problematic packaging upon delivery of the product or in case of sending it in a different form, returns and exchanges are not accepted.
**UNDELIVERABLE PRODUCT DUE TO UNFORESEEN REASONS:**
If unforeseen reasons occur that the Seller cannot foresee and the product cannot be delivered on time, the situation will be notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if payment is made in cash, the amount will be refunded within 14 days from the cancellation. If payment is made by credit card and is canceled, the product price will be refunded to the bank within 14 days from this cancellation, but it may take 2-3 weeks for the bank to transfer it to the Buyer’s account.
**BUYER’S OBLIGATION TO INSPECT THE PRODUCT:**
The Buyer will inspect the product/service subject to the contract before receiving it; they will not accept damaged and defective products/services from the cargo company. The received product/service will be deemed undamaged and sound. The BUYER must carefully protect the product/service after delivery. If the right of withdrawal is to be used, the product/service must not be used. The Invoice must also be returned with the product.
**WITHDRAWAL RIGHT:**
The BUYER may exercise the right of withdrawal from the contract within 14 (fourteen) days from the delivery date to themselves or the person/organization at the address indicated by the BUYER, without assuming any legal or penal liability, by notifying the SELLER through the following contact information.

The Buyer will notify the Seller of the withdrawal within 14 (fourteen) days using registered mail, fax, or email, and the product must not be used within the scope of the “Products for Which the Right of Withdrawal Cannot Be Used” provisions specified in this contract.
**USE OF THE RIGHT OF WITHDRAWAL:**
The invoice of the product delivered to a third party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution during the return. Order returns issued in the name of corporations will not be completed if the RETURN INVOICE is not issued.)
Return form, the box of the products to be returned, packaging, and, if any, standard accessories must be returned complete and undamaged.
**RETURN AND EXCHANGE CONDITIONS:**
The SELLER is obliged to refund the total amount to the BUYER and return the documents that put the BUYER under debt within a maximum of 10 days from the notification of the withdrawal and the arrival of the product to the SELLER. EXCHANGE IS NOT AVAILABLE. After the 14-day return period, exchange and return are not possible.
If there is a decrease in the value of the goods due to the fault of the BUYER or if it becomes impossible to return, the BUYER is liable to compensate for the damages of the SELLER in proportion to the fault. However, the BUYER is not responsible for changes and deteriorations occurring due to the proper use of the product or service within the right of withdrawal period.
If the campaign limit amount set by the SELLER due to the use of the right of withdrawal is exceeded, the amount of discount utilized within the scope of the campaign is canceled.
**PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:**
Products prepared according to the request of the BUYER or clearly tailored to their personal needs and cannot be returned, underwear, swimwear, makeup materials, disposable products, products that are prone to quick deterioration, products that are produced specifically for individuals or have an expiration date, products that are not suitable for return due to health and hygiene reasons if the packaging is opened after delivery, products mixed with other products after delivery and inherently cannot be separated, except for those provided within the scope of a subscription agreement, goods related to periodicals such as newspapers and magazines, electronic services or non-material goods delivered instantly to the consumer, including sound or image recordings, books, digital content, software programs, data storage
and data recording devices, computer consumables, returns are not possible if their packaging is opened by the BUYER. Also, the use of the right of withdrawal for services started with the consumer’s consent before the expiration of the right of withdrawal is not possible according to the Regulation.
Cosmetic and personal care products, underwear, swimwear, books, copyable software and programs, DVDs, VCDs, CDs, and cassettes, as well as stationery supplies (toner, cartridge, ribbon, etc.), can be returned only if their packaging is unopened, untested, undamaged, and unused.
**DEFAULT AND LEGAL CONSEQUENCES:**
In case the BUYER defaults on the payment transactions made with a credit card, the BUYER accepts, declares, and undertakes that they will pay interest to the bank due to the credit card agreement between the cardholder bank and them and will be liable to the bank. In this case, the relevant bank may apply to legal remedies; it can demand the expenses and attorney’s fees from the BUYER, and in any case, the BUYER agrees to pay the damages suffered by the SELLER due to the default of the debt of the BUYER.
**PAYMENT AND DELIVERY:**
By making a Bank Transfer or EFT (Electronic Fund Transfer) to our accounts at ………, ………, bank, you can pay in (TL).
You can use all types of credit cards with online single payment or online installment options on our website. In online payments, the amount will be charged from your credit card at the end of your order.
Deductions are made for undelivered orders due to incomplete or incorrect cargo and delivery information, address, or phone number entered by the customer. Other than that, shipping is free. If you want to return the product you purchased, you need to fill out the Return Application Form. After filling out the form, our customer representative will send you the information of the designer of the product you purchased and the cargo code within 1-3 business days. Returns made without filling out the form are not accepted.
Art Parisa Gallery does not make product shipments. Shipments are made by designers, and returns are made directly to the designers with the contracted couriers of the designers.
